Terms and Conditions for Pexels Meetups - Attendees

Our goal is simple: we want to make it easier for photographers all over the world to meet each other and grow their photography skills together. That's why we’re encouraging Pexels members to organise a meetup in their area—we’re so glad you’re interested in attending!

These are the Terms and Conditions for attending a Pexels meetup (the “Terms”). If you do not agree to the Terms, unfortunately you are not able to attend. By RSVP-ing to, and attending a meetup, you agree to be bound by these Terms.

1. Eligibility to attend a meetup

You must be a Pexels user and at least 18 years of age at the time of attending a meetup. You agree to be a good human in all of your interactions with other attendees, both online and in person. Pexels does not presently conduct background checks on attendees, however we reserve the right to do at any time using publicly available information.

2. Attendee acknowledgments

By attending a Pexels meetup, you acknowledge and agree that:

  1. Pexels is not responsible for the conduct of any Pexels meetup, including the provision of food, security or other amenities;
  2. Your participation in a meetup is solely at your own risk. You will take reasonable precautions to protect your safety and wellbeing, including in determining whether to share any personal information with other attendees;
  3. You will not:
    1. Engage in any violent, hateful, discriminatory or otherwise illegal behaviour;
    2. Solicit personal information, money or financial information from any person;
    3. Promote any commercial activities (without prior written consent).
  4. Your attendance at and participation in the meetup is completely voluntary and you assume responsibility for any illnesses or injuries you may sustain at or in connection with the meetup. You will abide by all local and national mandates and regulations related to COVID-19.

3. Pexels liability

You are solely responsible for your interactions with other Pexels users and third parties. Pexels is not responsible for the conduct of any meetup hosts or attendees and shall have no liability for your interactions with other people, or for any person’s action or inaction.

To the maximum extent permitted by applicable law, you hereby release Pexels, its affiliates, agents, directors, employees, suppliers or licensors from liability for any direct, indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, that results from your attendance at a Pexels meetup, including (but not limited to) your communications or meetings with other Pexels users.

4. Indemnity

You agree to defend, indemnify and hold Pexels and its affiliates harmless from and against any and all claims, damages, liabilities, losses or demands arising out of or in connection with (i) your attendance at a meetup; (ii) your violation of these Terms; and (iii) your violation of any applicable laws. The indemnity obligation includes the reasonable costs of legal defence, in particular lawyer's fees, necessary to defend against such claims.

5. How we will use your information

Pexels is committed to data privacy and protecting your personal information. Pexels uses the personal data you provide in this registration for administering your participation in this event. This may include information about the event’s content, event logistics, payment, updates, and additional information related to the event. Additionally, by submitting your email address during the event registration process, you agree that Pexels and its event partners may send you event-related information. A valid email address is required for all registrations.

Pexels may disclose your personal data to third party service providers engaged by Pexels to assist in the conduct of the event. Information you provide when registering for or participating in an event managed or co-sponsored by parties other than or in addition to Pexels may be shared with those parties, and the treatment of such information is further subject to the privacy policies of those parties. Except as described herein, Pexels will not disclose your personal data to any other third party without your consent except where required to do so by law.

6. Usage of photographic and video material taken at Pexels events

To comply with global data privacy laws, Pexels imposes certain restrictions on the use of multimedia at its events (e.g. photography, video, audio, online streaming, and all future mediums). An attendee is permitted to use hand-held cameras and/or smart phones to take photographs and capture digital images for personal, non-commercial use, provided the photography is not disruptive. Photographs may not be published, sold, reproduced, transmitted, distributed or otherwise commercially exploited in any manner whatsoever.

Pexels may hire professional service providers (photo/video/streaming/audio) to document and display the event experience. Pexels may also use social media (e.g. Twitter) to: (i) post real-time photos and videos to its social media feeds; and (ii) display select submissions from those feeds on monitors throughout the event venue. Attendees and sponsors are encouraged to capture their event experiences and post their own social content from the event (text, photos, audio, video, streaming), provided it does not infringe upon the rights of any attendee, sponsor, third party, or Pexels. Such infringement would include, but is not limited to, defamation or infringement of intellectual property rights. In the event an attendee requires a release or permission to protect the rights of a third party, obtaining such a release or permission shall be the sole responsibility of the attendee.

By attending the event, you acknowledge and agree as follows: (a) Pexels may edit and use footage it captures at the event for marketing and promotional activities and for any other lawful purpose in the ordinary course of its business; and (b) due to the prevalence of mobile recording devices in today’s world, Pexels disclaims all liability for the capture of your image in any multimedia format by other attendees at the event.

7. Choice of law

These Terms are governed by the law of the Federal Republic of Germany.

8. Miscellaneous

These Terms, together with the Host Terms contain the entire agreement between you and Pexels regarding your attendance at a meetup. Pexels reserves the right to change, amend, add or remove any of the above conditions in its sole discretion and without prior notice. If one or more of the conditions should become invalid, the remaining conditions will continue to be valid and apply.
